1. Who we are

Horosmith ("the app", "we", "us", "our") is operated by Alejandro Carbajo, an individual developer based in Spain. Contact: [email protected].

Once Spanish autónomo registration completes, this section will be updated with the registered business name and tax ID.

2. What Horosmith is

Horosmith is a local-first vault for serious mechanical-watch collectors: photograph each watch, log service intervals and accuracy over time, and generate insurance-ready PDF schedule riders in one tap. The app runs natively on iOS, Android, macOS, and the web (horosmith.app).

The "Lifetime" tier is a one-time purchase that unlocks the full vault, service log, accuracy log, photo discipline, insurance-ready PDF export, unlimited watches, and platform-native private sync — yours forever.

Optional add-ons:

• Valuation DLC ($29 one-time) — live market valuation from market-data feeds, per-watch alert thresholds, collection-value-over-time chart.
• Annual Content Refresh ($19/year, subscription) — updated insurance export templates and reference data each year.

3. Acceptance

By installing, signing in, or using Horosmith, you agree to these Terms and the linked Privacy Policy. If you don't agree, don't use the app.

You must be at least 13 years old (or 16 in jurisdictions where that's the minimum digital-consent age). The app is intended for personal use by individual collectors.

4. Your account

You may use the core vault without signing in. Signing in (with Google or Apple) enables cross-device sync via your own iCloud or Google Drive — see the Privacy Policy for what that does and does not entail.

You're responsible for keeping your sign-in credentials secure. We can't recover credentials we don't control (Apple ID, Google account password — those live with the respective platforms).

You may delete your account at any time. See the Privacy Policy for what happens to your data.

5. Purchases

How payments are processed

Purchases happen through:

• Apple App Store / Mac App Store on iOS and macOS — terms governed by Apple's Media Services Terms
• Google Play on Android — terms governed by Google Play's Terms of Service
• Paddle (Merchant of Record) on horosmith.app direct web purchases — terms governed by Paddle's Buyer Terms
• Stripe for select EU/B2B direct purchases on horosmith.app — terms governed by Stripe's Connected Account Terms

Each processor has its own purchase confirmation, payment instrument handling, and tax invoicing. Horosmith does not store or process payment-card details directly; we receive only the purchase receipt and the resulting entitlement grant via RevenueCat.

What you're buying

The Lifetime tier grants you a non-transferable, non-exclusive license to use the app's core vault and insurance-PDF features for as long as Horosmith remains a published, operational product. "Lifetime" refers to the product's commercial life, not your individual lifetime — we may sunset features, sunset the product, or be acquired; in any of those cases we'll notify you with at least 90 days' notice where commercially reasonable.

The Valuation DLC grants access to market-data lookup features. The underlying data feed is sourced from third parties (Chrono24, WatchCharts, or similar) and is subject to those providers' availability and accuracy.

The Annual Content Refresh is an annually-renewing subscription that delivers updated insurance templates and reference data each year. You may cancel at any time through your platform's subscription settings; cancellation takes effect at the end of the current billing period.

Refunds

Refund requests are handled by the store you purchased from:

• Apple App Store: https://reportaproblem.apple.com — Apple's standard policies apply
• Google Play: https://play.google.com/store/account/orderhistory — Google's standard policies apply
• Paddle (direct web): 30-day money-back, no questions asked. Email [email protected] with your Paddle order number; refunds process within 5–10 business days.

We don't issue refunds outside of these channels.

6. Acceptable use

You agree to use Horosmith for personal collection management. You may not:

• Use the app for commercial resale, dealer inventory management, or auction-house workflows (these are explicitly outside the product's intended scope and lane)
• Attempt to reverse-engineer, decompile, or otherwise extract the app's source code
• Scrape data from market-data providers through the Valuation DLC at volumes inconsistent with personal use
• Bulk-create accounts, automate sign-in flows, or otherwise circumvent platform IAP
• Use the app to track, surveil, or harass others
• Use the app for any illegal purpose

We may suspend or terminate access for material breach of these terms, with notice where commercially reasonable.

7. Intellectual property

What we own

Horosmith — including the app's source code, branding, design, copy, marketing materials, and all related intellectual property — is owned by Alejandro Carbajo. Using the app does not transfer any ownership to you.

What you own

You own all the data you create in Horosmith:

• Watch records you enter
• Photographs you take or import
• Service log entries you write
• Accuracy log entries you record
• Personal notes

We don't claim any rights in your watch data, photographs, or notes. The local-first architecture means we don't even have access to most of it — see the Privacy Policy.

8. Disclaimers

Not a substitute for licensed advice

Horosmith is a productivity aid — a tool for organizing your watch records. It is NOT:

• A licensed appraisal service. The Valuation DLC provides market-data lookup for reference only; do not rely on it for insurance claims, tax filings, or estate planning without independent professional appraisal.
• A licensed insurance broker. The "insurance-ready PDF" produces signature-ready schedule rider documentation of items in your collection — but your insurance policy, riders, and claims are between you and your carrier.
• A legal record of provenance. Watches are physical objects with physical provenance documents (receipts, certificates, service records). Horosmith helps you organize copies of those; it does not replace them.

Service availability

We provide the app "as is" without warranty of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or free from security vulnerabilities. Platform-native sync (iCloud, Google Drive) is subject to Apple and Google's own service availability.

Market data accuracy

The Valuation DLC retrieves market data from third-party providers. We do not guarantee the accuracy, completeness, or timeliness of that data. Use it as a directional reference, not as a precise valuation.

Limitation of liability

To the maximum extent permitted by law, Alejandro Carbajo's total liability arising out of or relating to these Terms or your use of Horosmith is limited to the amount you paid for the app in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages — including loss of data, loss of revenue, or loss of insurance coverage — arising from your use of the app.

This limitation applies regardless of whether the claim is based on contract, tort, statute, or any other legal theory. Some jurisdictions don't allow the exclusion of certain warranties or liabilities; in those jurisdictions our liability is limited to the maximum extent permitted by applicable law.

9. Termination

You may stop using Horosmith and delete your account at any time. Your lifetime entitlement remains valid for any future reinstall on a device you own.

We may terminate your access for material breach of these Terms. If we sunset the product, we'll notify you at least 90 days in advance where commercially reasonable, and we'll provide a JSON export tool so you can take your data with you.

10. Changes to these Terms

If we materially change these Terms we'll update the "Last updated" date above and notify you in-app or by email at least 30 days before the change takes effect. Continued use of the app after a change indicates acceptance.

11. Governing law and disputes

These Terms are governed by the laws of Spain, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of Horosmith will be resolved in the competent courts of León, Spain, except that:

• Consumers in the European Economic Area may bring proceedings in their country of residence and may rely on local mandatory consumer-protection laws.
• Consumers anywhere may use the European Commission's online dispute-resolution platform at https://ec.europa.eu/consumers/odr/
